Estherville man arrested for 3rd OWI offense

An Estherville man was arrested May 1 for operating while intoxicated and other charges after he was found unresponsive in a car near the 2200 mile of 300th Street in Clay County.

According to a sheriff’s office news report, a Spencer police officer who was also nearby and responded to the call found Roger Smith, 75, in the driver’s seat of 1999 Buick Park Avenue at about 10 p.m. that night.

Law enforcement had to force their way into the car. The officer smelled alcohol.

Deputies determined Smith was under the influence of alcohol following their investigation. Smith was arrested for OWI third offense, a Class D felony, and transported to the Clay County Jail.

Smith was arrested for additional charges of driving while barred, failure to install an ignition interlock device, failure to file SR-22 insurance and having an open container in the vehicle.

The Clay County Sheriff’s Office was assisted on scene by Fostoria Fire and Rescue, Spencer Hospital ambulance and the Spencer Police Department.
