Disturbance leads to OWI arrest, other charges

A driver was arrested for operating while intoxicated and other charges, while a passenger was cited for having an open container following a traffic stop last week in Spencer.

On July 7, the Clay County Sheriff’s Office responded to a reported disturbance in a moving vehicle on US-71 near Fostoria in which a male passenger was telling the female driver to pull over.

The sheriff’s office located the vehicle in the 10 block of West Eighth Street in Spencer and stopped the vehicle.


An investigation found the driver, Laura Schmoranz, 52, of Dewar, and the passenger, James Bedore, were having a disagreement and both had been drinking alcoholic beverages, according to a report.

Deputies conducted field sobriety tests with Schmoranz. She was arrested for OWI, first offense.

Open containers were found in the vehicle. Bedore was cited for having an open container and was released.


In addition to the OWI charge, a serious misdemeanor, Schmoranz was charged with open container, a simple misdemeanor, and child endangerment, an aggravated misdemeanor.

She was held in the Clay County Jail for an appearance before a magistrate judge.
